COMELEC Should Resume Voters Registration

voter-registrationA cornerstone principle and bedrock of our 1987 Constitution is that the Philippines is a republican and democratic state. One of the hallmarks of democracy is the people’s right to vote, a basic right upon which the fabric of any democracy is founded.

Last October 29, 2009, Kabataan Partylist, together with youth leaders from various organizations, along with prospective first-time voters, went to the Supreme Court to file a petition that, if granted by the Court, would urge the Commission on Elections (COMELEC) to resume the registration of voters until January 9, 2010 from its self-imposed deadline of October 31, 2009.

The petition was based on two legal arguments. First, the October 31 deadline of the COMELEC is seventy (70) days short of the deadline prescribed by law under the Voters Registration Act of 1996. Second, for effectively amending the law by setting the deadline prior to the prescribed date, COMELEC usurped the legislative power of Congress.

Beyond the legal bases, I would like to assert the conditions that make the affirmative granting of the petition imperative and urgent. In a recent press release, the COMELEC announced that they were able to accommodate 2.736 million new voter registrations for the 2010 elections. This figure falls short of the 3 million prospective new voters that COMELEC targeted a few months earlier and even farther from the 5 million prospective new voters that it targeted at the beginning of the year. In fact, the National Statistics Office, by its own calculations, estimate that there are 10 million unregistered eligible voters that should be accommodated. The lowering of its own target is itself an act of admission from the electoral body that it will be unable to accommodate all new voters within its deadline. Despite this, COMELEC insisted on imposing their earlier deadline and refused the many appeals for extension. An earlier report even claimed that the COMELEC had delisted more than 6 million voters from its registry, up to 3.4 million more than it had accommodated to register. The glaring fact is up to 7 million eligible voters were unable to register in the shortened registration period. COMELEC counters any appeal for an extension by invoking the fear of a failure of elections in light of the new automated system. Isn't the disenfranchisement of up to 7 million voters an even greater failure of elections in itself? Nowhere in the poll automation law did it say that COMELEC has been granted the prerogative to shorten the voters registration period in lieu of preparation for the automated elections. Poll automation and voter registration are major responsibilities of the Comelec and they cannot just simply drop the one in favor of the other.

Blame cannot be put entirely on Filipinos' “last minute” habit. This year witnessed a confluence of tragedies that affected voter registration: the swine flu outbreak, deaths of important personalities that spawned non-working holidays, and the massive flooding brought about by supertyphoons Ondoy and Pepeng. Moreover, the low turnout can also be attributed to the fact that the Comelec did not have adequate resources and manpower to accommodate hundreds of registrants per day.

In less than a month, the petition will have become moot and academic. By January 10, regardless of a favorable ruling by the Court, the deadline prescribed by law (120 days before day of the elections) would have lapsed and millions of prospective first-time voters would have permanently been disenfranchised for the coming elections.

The Court has proven many times that it can act swiftly on matters of national interest when legal resolution is urgent and when it wills it. I personally find no reason for the Supreme Court to delay affirming the constitutional right of suffrage to millions of Filipinos who have been injured by COMELEC's actions, or inactions for this matter. It us thus imperative for the Court to render a positive resolution to Kabataan Partylist's urgent petition at the soonest possible time, before everything else is too late.

they should give extension. I have observed the registration at least 3 times and it was not the last minute registratrion. The Comelec was just not prepared for the great number of registrants. Imagine, some of them went to my blog to download forms because they lacked forms. These voters were very eager to register. Imagine what it is like for others.

Personally?.. I guess it is the "last minute" habit of the Pinoys.. Last registration period.. I was not able to register for I was thinking mahaba pa naman ang time. I failed to register kase yung last 2 months talagang ang haba na ng pila.

this year registration, I made it a point to register earlier. And everything is a breeze.. and I was able to register.

SM Malls have schedule of registration, the first day it was launched.. walang tao. The a nnouncement are posted sa mall entrance. kaya nakita ko and made it a red day for me.

Can you blame comelec?.. They are all there waiting for registrant but few came. I guess the time they gave is enough (my opinion)

Why don't we see people lining up for registration the same eagerness (up to 12 midnight nung last day na? ) when the registration is regularly on going?

Kung talagang gusto mag-register kahit gabi na pipila ang Pinoy at hindi dahil last minute na...

Kaya naman pala pumila ng kahit hanggang gabi.. eh di sana ginawa na nung una pa.

And for sure ABS-CBN/GMA7 will air it and force Comelec to extend on a daily basis their registration to accomodate.

Mga Pinoy lang talaga gusto last minute...

And pag hindi napagbiyan.. ayan na puro reklamo.

Bakit walang nagreklamo nung una mga buwan ng registration?

Bakit walang nag-file sa SC for extension nung sinabi palang na until October? Why file only when Octo 31 is fast approaching or lampas na?

I am not for the Comelec, I also learned my own lesson in registration.

have faith in the Filipino people. How do you know how the rest feel? How do you know the circumstances that didn't make them register early?

Remember intensive registraion info didn't start as early as December last year.

ang totoo, kahit sasabihin pa natin na short ng 70 days yung registration period, masisisi pa rin natin ang ating mga sarili dahil nga sa sinasabing "last minute attitude."

Kung tutuusin, kung noong December 2008 ay nagsimula nang magparegister yung dapat magpregister, baka june 2009 palang tapos na ang registration.

Pero hindi e. Hinintay pa natin na bahain tayo, bagyuhin, masunugan, anu pa man, bago tayo kikilos.

Sa tingin ko kung noon pa ay january 2010 na ang deadline ng registration, sigurado ako, kikilos lang ang mga magpaparegister kung november at december na.

Kaya, suggestion ko sa mga leader ng kabataan pangunahan niyo ang mga kabataan sa pagkatoto sa pagdisiplina ng sarili.

Many groups, including Kabataan, have been continuously appealing for extension from the COMELEC long before October to no avail. The SC petition was done when all else failed. It was not a random out of the blue "reklamo".

A man gets hit and run over by a car. You can blame the man all you want that he crossed the street at the wrong place. Following your logic, the driver has no liability at all for the death of a hapless jaywalker. It's the jaywalker's fault anyway, he deserved to die.

Does that sound right to you?

Your dislike for other people's habits does not justify a violation of the law and of their constitutional right to suffrage

Well that's your opinion and you have the right to one. I just expressed my own.

The "reklamo" word is for a mortal like me. If it should not be used, pardon me. But why not go to SC when every means failed?.. still waited for Oct 31 for SC?..

And the man and the car thing?.. it is your opinion too. For me I have to ask, how fast is the car?.. how long is the street the man is crossing?.. is it day light or night time?, is the car registered or not? too many variables to consider in a specific and confined situation.

And we cannot blame Ondoy for not being able to register.. Ondoy didn't hit the whole Philippines, Swine flu didn't too... shortage of Comelec manpower
is not prevalent for the whole Phils.

For if this will be the reason, then I should have not able to register at all.

Now na SC ordered extension of registration, I just hope that those who will benefit from this order should go out and register!

I agree with loadex. my bf should've voted in 2004 and 2007 but he was too lazy to fall i line and sign up. now that the sc has ruled an extension... hihilahin ko na talaga para bumoto.

i know so many first-time voters who weren't able to register. it's great that the registration was extended 'til January

good thing that SC ordered this decision for COMELEC to extend their voter's registration.. ang dami pa kayang di nakakapagparehistro at sana naman, magparehistro na sila habang malayu-layo pa sa deadline...

siguro ang mas mabuting gawin natin dito ay turuan ng disiplina ang bawat Filipino.

Sana kung totoong nagmamalasakit tayo sa kanila at nais nating matulungan silang maka-vote, dapat noong December 2008 pa lang ay kumilos na ang mga leader ng kabataan na siyang kumikilos ngayon.

Sa tingin ko, kahit mga leader ng kabataan ay kagaya din ng karamihan ng mga kababayan na kikilos lang kung deadline na.

Maaring may point nga tayo, short ng less than 100 days ang registration, pero ba't ngayon lang kayo kumilos? Sana noon pa kumilos na tayo, pinursige natin yung mga kababayan na magparehistro na at nang maaga pa lang ay maisaayos na ang problema na masasagupa natin.

It's very easy to assume that other people haven't been doing anything and are simply "tamad"

Tama naman sinabi mo. Kabataan Partylist, as well as media institutions, and many other groups have been conducting voters registration campaigns the entire year.

But it doesn't matter kung naiinis kayo sa mga tamad, the law is the law and they are Filipinos who deserve the right to vote as much as those who registered earlier.

Kung nakapag-register na kayo, why do you have a problem with other people registering later than you? Ganon ba kayo ka-damot sa karapatan?

Registration must continue until 120 days before the elections. If you have a problem with it, petition your congressmen to change the law.
